How do I get child support?

A very common question is, how do I get child support? If parties are able to mutually co-operate they may agree on the amount of child support payable on their own. It is highly recommended this be an arrangement based in writing. Also, important that the child support payable should be in compliance of Ontario law. For those concerned about legal fees, it is a good idea to at minimum consult with a lawyer.

In the event the parties are not able to get along, then family court is the only other option. In this scenario the party seeking child support will make an Application to the court. Financial information will have to be exchanged along with expenses etc. The court will decide on the amount of child support payable based on law.

 I can’t afford child support payments anymore because my income has changed?

A common situation can be where the payor’s income status has changed. For example, they lost their job or they are paying off other debts. In this scenario if child support was payable based on an existing court order the individual looking to change it may apply to court.

This will be referred to as seeking to vary an order or a motion to change. The payor will have to demonstrate why they are unable to pay it and that it is causing them undue hardship. This will also have to be viewed in light of the legal standard of living test. According, to this test the parent claiming undue hardship must demonstrate that their standard of living is lower than the standard of living for the parent who is receiving the payments.

Normally, satisfying this test is difficult.
