Small Claims Court

Small Claims Court is a legal system established in Ontario for people to deal with minor disputes. The system is quite informal but still has many rules and applicable legal principals.

One of the most common questions I get asked about Small Claims Court is whether or not a lawyer is needed. My answer is always no, but starting or defending legal proceedings in Small Claims Court can take up a lot of time. There are deadlines, filing requirements and court attendances.

Generally, you should speak with a lawyer if you are thinking of starting a Small Claims Court action or have been sued. Many lawyers do not even deal with Small Claims Court cases for a variety of reasons.

In many cases, Judges at Small Claims Court will attempt to resolve the issue in a manner that is fair and equitable. Your chances of success are always based on your preparation and the evidence you have.

Blackberry Woes

The popular smart phone Blackberry manufactured by RIM is butting heads with the UAE, Saudia Arabia and India.

The three countries have concerns over the way in which messages are sent over the RIM network. All data is sent through servers at RIM`s headquarters in Canada. The BBC reported that RIM does not permit any third party or even RIM itself to read any of the data that is sent through its servers.

The UAE and Saudia Arabia have already announced deadlines for RIM to comply. Blackberry has become increasingly popular in Asia and the Middle East. Its popularity is due to its email functions, peer to peer messaging capabilities and text messaging.

Superbug

The Globe and Mail reported that we are about to expect another outbreak of a bug described as NDM-1 also known as the ``super bug``. It is believed that the superbug originated from India or Pakistan. The UK has already reported numerous people infected with the superbug. The Globe and Mail reported that two Canadians have been infected.

The bug is described as a superbug because it is resistant to all forms of antibiotics.

Health officials describe the situation as alarming.

The Globe and Mail reported:

NDM-1 is an enzyme that is produced by bacteria that renders most antibiotics inactive. It is commonly harboured in E. coli and Klebsiella pneumoniae. People infected with NDM-1-producing bacteria often contract urinary-tract infections, pneumonia or blood infections.

Lawsuit Against Coca-Cola

A while back I discussed legal disputes against manufacturers such as Dannon the yogurt maker, Kellogg`s and Snapple. The three separate lawsuits were started due to misleading or deceptive advertising and marketing campaigns.

Typically, such suits challenge a companies claim to their product for example, that the product is all natural, or that it provides a certain health benefit.

The latest suit in America has been started by the Centre for Science in the Public Interest. The suit involves Coca-Cola`s brand of Vitaminwater. Aside from the obvious, its name, the product is marketed and advertised in a manner that gives the perception it is a healthy drink. Just take a look at the label.

Surprisingly, Coca-Cola in defending the lawsuit claims, no consumer could reasonably be misled into thinking vitaminwater was a healthy beverage" as reported in the Huffington Post. Also, Coca-Cola`s court application to dismiss the claim was not granted by the court.

This will be an interesting lawsuit as Vitaminwater clearly seems to be a product that provides health benefits. Incidentally, Dannon ended up paying out $35 million dollars because of the lawsuit it faced.

G20 Class Action

The Toronto Star reported today that a twenty year old woman has filed a class action lawsuit against the police related to the G20.

A class action lawsuit is where one Plaintiff is named in the suit and acts as a representative for numerous others. In this case, the Star has reported that there are approximately 800 other individuals in the class action suit.

This lawsuit comes as no surprise given the chaos and controversy surrounding the G20 security structure. The actions of police officers and the special powers given to them during the G20 will be a main point of interest in the lawsuit.

Plot To Kill Local Jeweller

The Globe and Mail reported a story today that seems to be straight out of the movies but it isn`t. Toronto Police have arrested two in connection with a plot to kill a local jeweller. The Toronto jeweller is, Jack Berkovits, of Omni Jewelcrafters.

The alleged hit-man was an Iranian fellow who worked as a security guard for another well known jeweller, Harold Gerstel of Harold the Jewellery Buyer. The second person arrested is a 71 year old lady identified as Maria Konstan, also an employee of Harold the Jewellery Buyer.

Both jewellers operate in direct competition from one another. The Globe reported that Jack caters to high end buyers whereas, Harold caters to people desperate for cash.

Jack Berkovits is a frequent advertiser on the popular Toronto radio station CFRB and was interviewed this morning. He said he was grateful to be alive. He stated that the Iranian security guard whom he had never met before contacted him and wanted to meet in private in regards to a large amount of gold he had to sell. The two met in a coffee shop, discussed business and their personal lives. Following the conversation the Iranian security guard stated he could not kill Jack. Of course, on hearing this Jack had great concern and reported the matter to the police. Even more interesting the alleged Iranian hit-man also contacted the police and provided a videotaped statement.

This is a very interesting story and will certainly be followed by many. Currently, Harold Gerstel has not been charged with anything.

According to the Canadian Medical Journal, energy drinks can pose serious health risks to kids.

Energy drinks have long been under scrutiny due to high levels of caffeine.

The Globe and Mail reported:

Energy drinks that contain high amounts of caffeine – some more than five times the amount in a can of cola, or nearly double the amount in a cup of brewed coffee – can pose serious health risks to children and adolescents and require stronger warning labels, according to the Canadian Medical Association Journal’s editorial.

The Globe and Mail also reported:

In June, it (House of Commons health committee) heard from a man named James Shepherd who said his 15-year-old son died from an unexplained arrhythmia (irregular heartbeat) in 2008 after he had consumed a Red Bull energy drink. He said he believes the drink contributed to his son’s death.

Energy drinks have become widely popular amongst young people and readily available at almost any convenience store. Manufacturers, heavily target young people as primary consumers of their products.

As a consumer it`s important to be aware and cautious when making purchasing decisions for you and your family.
