Should I Sue?

No. In fact, most experienced civil litigation lawyers will often advise that starting a legal case should always be the last resort.

There are many factors to consider when considering commencing a legal action such as, costs, time and what you hope to achieve. In some situations starting a legal action can bring good results. However, I find that in many cases people become exhausted dealing with the various court processes and legal fees.

After practising civil litigation for approximately 11 years I can honestly say that court rarely is a good option. Most lawyers will ask for a financial retainer at the outset in the amount of $2000 to $5000 or even more. For most, of the middle class this is an incredible amount of money. Also, let’s face it you would rather spend that money somewhere else.

If you are thinking of starting a legal case consider the following:

  • Legal fees;
  • Legal disbursements;
  • Is your case really worth it;
  • How much time are you willing to invest;
  • Does the Defendant even have money;
  • Is your lawyer experienced;
  • What if, you did end up losing;
  • Are you prepared to sit through a civil litigation trial
  • Are your witnesses reliable;

Should I loan money to a friend?

I want to borrow money - I want to loan money. What should I do?

A common transaction is where people will borrow money from a friend or family member. Often people will call and ask whether they need something in writing. If so, how formal should the document be?

First, an oral agreement or contract is binding on parties. If there is a breach of the oral agreement parties can sue. However, suing pursuant to an oral agreement always presents many challenges. Parties will dispute the terms of the arrangement such as, how soon the loan should have been paid back or the term of interest.

Second, this is why we always recommend that any type of loan agreement be in writing. It protects the parties and provides clarification.

Depending on the amount being loaned you might consider a very formal agreement or informal. If you are thinking of loaning or borrowing a substantial sum of money it`s a good idea to speak with a lawyer. A lawyer can guide you through the process and protect your rights. The absence of an agreement can cause tremendous uncertainty and confusion that will complicate the litigation process.

There are many circumstances where people will opt not to have a written agreement. Typically, if it involves a close family member.

In my most recent post I blogged about hiring a lawyer. In this post I would like to talk about working with a lawyer.

People are often confused, frustrated and sometimes even angry at the rates that lawyers charge. However, lawyers are like any other service provider.

Ever get an estimate on a home renovation project? Only to find out later that the estimate is different because of alterations, unforeseen events or new circumstances? Ever take your car into the garage only to find out the price quoted was different?

This is often the case with lawyers as well.

Sure, there are many service providers that overcharge or are not upfront about their costs. Then there are others that are not.

Some matters are simple and straight forward. For example a real estate house closing. Whereas, others matters can be significantly more complicated such as civil litigation lawsuits, or family law disputes.

When you decide to work with a lawyer ensure you are aware of his or her hourly rate. Determine whether this is a matter that will be billed on an hourly rate or it will be a flat rate.

Find out how much of the quote is for legal fees and how much is for disbursements.

Disbursements are expenses that lawyers have to pay on your behalf. These are often factored in the quote provided.

Finally, don`t forget tax is payable on legal fees.

Ensure when the lawyer bills you that you are provided with an invoice. Typically, it`s good practice for the lawyer to provide a breakdown of the legal services. This is not often the case when the matter is on contingency or on a flat fee.
