I always take the time to listen to the pain of a parent or to hear the frustrations of a spouse. At my law office your children and their future is always my top priority.

In most situations, I will always suggest court as the last option. However, I understand dire circumstances such as, negligent parenting, abusive parenting, parental alienation and a toxic environment.

CHILD CUSTODY/ACCESS

Child custody and or access to a child is definitely, one of the primarily reasons why family court cases can become viscous. On the breakdown of a marriage, parents must decide on custody arrangements for their children. In other words, who gets the kids. Parents have three options:

  • Sole Custody: The child lives with you and you are able to make all important life decisions. Unless, there is an separation agreement or court order that says otherwise.
  • Joint Custody: Both parents are involved in making decisions together. Children may live equally with both parents or not. What's important here is that relevant decisions affecting the child are made together.
  • Shared Custody: This is more about ensuring the children spend an equal amount of time with each parent. This can have implications on child support.
  • Split Custody: One parent will live with each child.

Unless, there are serious, harmful consequences I will always urge regular contact between parents and their children.

When a divorce or separation happens the financially weaker party make seek spousal support.

On the breakdown of a marriage child support will be payable to the parent with primary custody of the children.

If you are looking to obtain a divorce immediately there are a few important things to keep in mind. The parties will have to be separated for a one year period. Further, if they reconcile they can do so for up to 90 days without interrupting the one year clock.
